Corrections to Sept 6th Export Controls Published

On September 6, 2024, BIS published in the Federal Register an interim final rule entitled “Commerce Control List Additions and Revisions; Implementation of Controls on Advanced Technologies Consistent with Controls Implemented by International Partners”  that contained inadvertent errors. This rule corrects those errors.

To support export controls on several semiconductor, quantum, and additive manufacturing items, this rule adds new Export Control Classification Numbers (ECCNs) to the Commerce Control List, revises existing ECCNs, adds a new license exception to authorize exports and reexports to and by countries that have implemented equivalent technical controls for these newly added items, and adds two new worldwide license requirements to the national security and regional stability controls in the Export Administration Regulations (EAR).

Key corrections include:

1. Corrections to EAR Sections:
• Errors in citations and paragraph designations in §§ 742.4 (National Security), 742.6 (Regional Stability), and 743.7 (Special Reporting and Notification) were corrected.
• Examples:
• Replacing incorrect references to “general order no. 4” with “general order no. 6.”
• Clarifying designations for quantum-related items and deemed export/reexport exclusions.
• Redesignating paragraph structures for better clarity.


2. Corrections to CCL Entries:
• Errors in ECCN 2B910 (e.g., incorrect citation to 2B010.c) and ECCN 3C908 (e.g., duplication of Regional Stability license requirements, omission of Anti-terrorism license requirements) were rectified.

3.. Updated Controls:
• Corrected descriptions of controlled technologies, materials, and items under ECCNs 2B910 and 3C908, including specific technical notes and license requirements.
