CBP: Dumping and Subsidy Offsets to Affected Producers

Pursuant to the Continued Dumping and Subsidy Offset Act of 2000,  Customs and Border Protection’s (CBP) issues notice of intent to distribute assessed antidumping and countervailing duties (known as the continued dumping and subsidy offset) for Fiscal Year 2024 in connection with countervailing duty orders, antidumping duty orders, and findings under the Antidumping Act of 1921.

CDSOA, otherwise known as the Byrd Amendment, was passed on October 28, 2000 and was repealed effective October 1, 2007. The provisions of this act allow for anti-dumping and countervailing (AD/CV) duties collected by CBP to be disbursed to domestic producers injured by foreign dumping and subsidies. Per the repeal, AD/CV duties collected on entries made prior to October 1, 2007 are still eligible for CDSOA at liquidation.

The document provides the instructions for affected domestic producers, or anyone alleging eligibility to receive a distribution, to file certifications to claim a distribution in relation to the listed orders and findings, and to provide CBP with the necessary information to effect payment of a distribution by electronic funds transfer.

CBP intends to distribute to affected domestic producers the assessed antidumping and countervailing duties, section 1677g interest, and interest provided for in 19 U.S.C. 4401 that are available for distribution in Fiscal Year 2024 in connection with those antidumping duty orders, findings and countervailing duty orders that are listed in this document.

The continued dumping and subsidy offset that affected domestic producers receive for Fiscal Year 2024 will include the funds that were temporarily sequestered during Fiscal Year 2024.
