Hill Republicans Blast BIS for Huawei Phone

House Republicans, led by Chairman Michael McCaul, have urged the Bureau of Industry and Security (BIS) to take stringent action against Chinese tech giants Huawei and SMIC. According to a letter sent to BIS Under Secretary Alan Estevez, the lawmakers cited national security concerns following reports of Huawei's new smartphone which integrates 7-nanometer chips developed by SMIC, allegedly violating U.S. export control regulations.

The lawmakers criticized the BIS for failing to enforce effective export control rules against China, accusing the bureau of permitting loopholes that allow significant technology transfer to companies like Huawei and SMIC. Despite repeated warnings and pressures from Congress to tighten the rules, the BIS allegedly continued granting licenses to firms controlled by the Chinese Communist Party (CCP), which are purportedly aiding the CCP’s military initiatives and potentially undermining U.S. security protocols.

Demanding immediate actions, the letter outlined a series of recommendations including imposing sanctions and restricting imports of products from these companies, listing them on the Entity List with a Foreign Direct Product Rule (FDPR) designation, and even suggesting criminal charges against their executives.

The representatives have requested a multi-departmental briefing, involving the Departments of Defense, State, and Energy, to further discuss the national security implications of these alleged violations, scheduled for September 28th. The lawmakers emphasized the necessity for stronger export controls to counter the evolving threat dynamics in U.S.-China relations.
